Appeal for murder conviction dismissed

A three-judge panel has dismissed an appeal for a Fort McMurray DJ who was convicted in the shooting death of his roommate.

Thirty-eight-year-old Dax Richard Mack was convicted on February 22nd, 2008, after the 2002 death of 25-year-old Robert Levoir. Mack was also charged with burning the victim’s body. Levoir’s remains were found in April 2004.

The Edmonton Sun says defence lawyer Laura Stevens had argued the trial judge erred in his instructions to the jury, by giving inadequate warnings regarding the dangers of confessions given during controversial police operations.

The panel of the Court of Appeal of Alberta rejected the various grounds of appeal argued by Mack, and they also denied his motion to have fresh evidence looked at. They say no error was made in admitting police evidence, and said there was no basis for the argument that he had given faulty instructions to jurors.
