Jackpine expansion panel to decide on constitutional challenge

The panel reviewing the expansion of Shell’s Jackpine mine says it won’t decide yet whether an aboriginal group can make a constitutional challenge.

The Athabasca Chipewyan First Nation filed the challenge earlier this month.

It claims Shell and the province didn’t consult with them enough on the project’s design.

It also says it won’t be able to exercise treaty rights to use the land for traditional activities if changes aren’t made.

The panel says it’ll decide this week whether to deal with the issue or if it has to go to a court.
