Suncor has made its appeal to get its random drug testing program back on track.

It told the highest court in Alberta yesterday that delaying the program increases the risk of injury, death, or environmental catastrophe at the site.

Its lawyer said that risk goes up with every day that passes.

But the union disagreed, saying that if the danger was so imminent, the company wouldn’t have waited four months to implement the program after it was announced back in June.

The program was supposed to start Monday but a court injunction stopped it.

There’s no timeline yet for the judge to rule on the appeal.
